The Central Guide Informational Sessions – Additional Dates: Monday, October 6, 2023, and Monday, December 11, 2023

Please join us in 2023 for a one-hour ZoomGov update on new features and links in The Central Guide (TCG). For the past year, the Court and public have enjoyed using The Central Guide to access information about filing papers, attending hearings, serving documents, giving notice, and other procedures in our Court. TCG users can look up rules and links to forms and instructions that match those rules, and access related information on websites for the U.S. trustee, U.S. District Court, Bankruptcy Appellate Panel, and the Ninth Circuit Court of Appeals. Court staff worked diligently to fine-tune The Central Guide and there are many updates we will share with you during the informational session.

Request for Public Comment on Proposed National Rules and Forms Amendments

The Judicial Conference Committee on Rules of Practice and Procedure (Standing Committee) has proposed amendments to their respective rules and forms and requested that the proposals be circulated to the bench, bar, and public for comment. The public comment period ends on February 16, 2024.

Eastern District of California

General Order 23-07, Delegation of Authority to the Clerk of the Bankruptcy Court and his Deputies

IT IS FURTHER ORDERED that Wayne Blackwelder, the duly appointed Clerk of the U.S. Bankruptcy Court for the Eastern District of California, and his deputies shall have the same rights and powers, shall perform the same functions and duties, and shall be subject to the same provisions of Title 28, United States Code, as a clerk and other employees appointed under 28 U.S.C. § 751. Pursuant to the provisions of 28 U.S.C. § 956, 11 U.S.C. § 105, and the Federal Rules of Bankruptcy Procedure, the clerk and such deputies as he may designate are authorized to sign and enter without further direction the following orders which are deemed to be of a ministerial, nondiscretionary, nonjudicial, and/or administrative nature.

Northern District of California

Procedures for Noticing and Conducting Hearing in the San Francisco Division of the United States Bankruptcy Court for Northern District of California (Effective September 1, 2023)

Effective September 1, 2023, all debtors, creditors, counsel, and other interested parties shall comply with the following procedures when noticing or participating in hearings in cases assigned to Judge Dennis Montali or Judge Hannah L. Blumenstiel. Failure to comply with these procedures might result in vacatur of a hearing or the imposition of sanctions.

Request for Public Comments on Proposed Amendments to Local Rules and Forms

The United States Bankruptcy Court for the Southern District of California, having considered comments and suggestions provided by its Local Rules Advisory Committee, proposes amendments to Local Bankruptcy Rules 1001-1; 1006-1; 1006-4; 1007-5: 1017-2 (a)(1) and (b)(2); 2002-2(h); 4002-1 (b); 9010-4; 9013-4 (a) and (b); Appendix A; and Appendix B.  Click HERE for the proposed amendments.  Amendments will be made effective December 1, 2023.
