NOTICE TO ATTORNEYS and SELF REPRESENTED LITIGANTS RE CHANGES IN FAMILY LAW STATE & LOCAL RULES

Family Code, section 245, was amended effective January 1, 2016. To implement the change in the law, the Judicial Council amended the California Rules of Court, rules 5.92, 5.94, and 5.151, and adopted new and revised forms effective July 1, 2016. These rules of court affect procedures on the continuance of hearings and the modification or termination of orders on applications for domestic violence restraining orders and requests for orders with temporary emergency (ex parte) orders.

To eliminate any conflict with California law and the California Rules of Court, the court suspends local rule 5.4.1 in its entirety, local rule 5.4.3 in its entirety, and local rule 5.5.1, subsections E. and F.1., effective July 1, 2016. The subject matter of these suspended local rules will be governed by the Family Code and the California Rules of Court.
