LOG ANGELES – CHANGE IN EX PARTE FILING SCHEDULE IN PROBATE DIVISION

Effective June 5, 2017, Los Angeles Superior Court will change the schedule for processing of ex parte documents in the Probate Division. Local Rule 4.12(a) will be amended by order of the Presiding Judge, as follows:

The Probate Division will require ex parte applications and all supporting documents to be filed no later than 10:00 a.m. one court (business) day prior to the date of the ex parte application. Any written opposition shall be filed by 8:30 a.m. on the day of the ex parte application. Attorneys are required to electronically file (e-file) ex parte applications and any opposition. Any written opposition e-filed after 4:00 p.m. requires that a courtesy copy be submitted to the Probate Clerk’s Office by 8:30 a.m. the day of the ex parte application.

Pursuant to California Rules of Court, Rule 2.253(b)(2) and Code of Civil Procedure section 1010.6, self-represented litigants are exempt from mandatory electronic filing. Self-represented litigants may choose to e-file or conventionally file their documents in the Clerk’s Office.

Appearance by the applicant and the proposed order are required on the day of the ex parte application. These documents shall be brought to the Probate Division Clerk’s Office by 8:30 a.m. on the day of the ex parte application. Parties and attorneys appearing on the ex parte application shall report to the Probate Division’s Clerk’s Office by 8:30 a.m. on the day of the ex parte application.

The foregoing does not change the notice and other requirements for an ex parte application under Local Rule 4.12 or under California Rules of Court, Rule 3.1200, et. seq.
