Buchanan While some lawyers were adept at remote work prior to the pandemic, the majority of us were catapulted into this strange new world by the global pandemic in 2020. Three years later, even as many lawyers have returned to in-person work, there is no doubt that things in the legal field have changed forever. Many firms are offering hybrid work options for lawyers and staff. Some firms have transitioned to being fully remote (and fully paperless). Many courts have a strong preference for video appearances, rather than in-person appearances. For some, this "new normal" is a blessing; for others, a curse. This CLE program will address ethical issues that arise in the context of virtual remote work, including but not limited to competency (Rule 1.1), the duty to communicate (Rule 1.4), confidentiality (Rule 1.6), conflicts (Rules 1.7 and 1.9), the duty to supervise (Rules 5.1, 5.2, and 5.3), multijurisdictional practice (Rule 5.5), and others. Alison Buchanan is a Shareholder in the firm’s Silicon Valley office, where she focuses her practice on business litigation. Alison is the Chair of the firm's Business Litigation Practice Group. She represents clients in complex business disputes, including contract, fraud, misappropriation of trade secrets, unfair competition claims, and employment law litigation. She has significant trial experience, including serving as lead trial counsel in jury and bench trials in state and federal court.
